1. Agreement to these Terms
These Terms of Service form a binding agreement between you and the operator of TagIn regarding the TagIn website, applications, and related services collectively referred to as the Service.
By creating an account, selecting an acceptance control, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use TagIn.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use TagIn. You may not use the Service if you are prohibited from doing so under applicable law or if we previously removed or permanently suspended you, unless we give written permission.
By using TagIn, you represent that the information you provide about your age and eligibility is accurate.
3. Accounts and security
- You must provide accurate, current, and complete information and keep it updated.
- You may create only accounts that belong to you and may not impersonate another person or organization.
- You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account.
- You must promptly notify us at support@tagin.ca if you suspect unauthorized access.
- You may not sell, transfer, rent, or share access to your account.
We may require identity, age, email, phone, or other verification where reasonably necessary for safety, security, or compliance.
4. What TagIn provides
TagIn helps users discover local events, people, plans, groups, and conversations; create or join activities; match and message; and interact through other social features. Features may vary by location, device, account, testing group, or availability.
TagIn is a technology platform. Unless explicitly stated otherwise, we do not organize, supervise, endorse, control, insure, or guarantee user-created events, plans, groups, profiles, statements, or interactions.
5. Acceptable use
You agree not to use the Service to:
- harass, threaten, stalk, exploit, shame, intimidate, or harm another person;
- post hateful, discriminatory, sexually exploitative, violent, illegal, fraudulent, or deceptive content;
- solicit minors, misrepresent your age or identity, or facilitate unsafe or unlawful conduct;
- share another person's private information without authorization;
- send spam, scams, unauthorized advertising, chain messages, or bulk solicitations;
- buy, sell, or promote illegal goods, controlled substances, weapons, trafficking, or prohibited services;
- scrape, harvest, index, reverse engineer, probe, overload, disrupt, or bypass security or access controls;
- use bots, scripts, fake accounts, or automation without our written permission;
- copy or commercially exploit the Service except as expressly allowed;
- encourage or assist anyone else in violating these Terms.
Additional Community Guidelines may apply and are incorporated into these Terms by reference.
6. User content
Your ownership
You retain ownership of photos, text, messages, event listings, comments, and other content you submit to TagIn, referred to as User Content.
Licence to TagIn
You grant TagIn a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, modify for technical or formatting purposes, display, distribute, and otherwise use your User Content as reasonably necessary to operate, improve, promote, secure, and provide the Service. This licence is limited by your settings, the nature of the feature, our Privacy Policy, and applicable law.
The licence ends when your content is deleted from our active systems, except where content has been shared with others, retained in backups, or preserved for legal, security, moderation, or legitimate operational reasons.
Your responsibilities
You represent that you have all rights and permissions needed to submit User Content and that doing so does not violate law, privacy, intellectual property, publicity, or contractual rights. You are responsible for your content and interactions.
7. Events, plans, and offline interactions
Users may create, host, promote, or join activities. Hosts are responsible for the accuracy, legality, accessibility, safety, capacity, permissions, costs, rules, and operation of their activities. Attendees are responsible for deciding whether an activity is appropriate and safe for them.
TagIn does not guarantee that an event will occur, that information is accurate, that a host or attendee will appear, or that any person will behave safely or lawfully. Arrangements, payments, transportation, alcohol consumption, waivers, venues, and disputes between users are generally the responsibility of the users involved.
8. Safety and meeting people
Meeting strangers and attending real-world activities involves risk. Use judgment, meet in public when appropriate, tell someone you trust where you are going, arrange your own transportation, protect personal and financial information, and leave or contact emergency services if you feel unsafe.
TagIn does not conduct a comprehensive background check on every user and cannot guarantee any user's identity, intentions, history, or conduct.
Reporting and blocking tools support community safety but are not emergency services. For an immediate threat or emergency, contact 911 or the appropriate local authority.
9. Payments and paid features
TagIn may introduce subscriptions, ticketing, boosts, premium tools, or other paid features. Prices, taxes, billing periods, renewal terms, cancellation rights, and refund rules will be disclosed at purchase. Payments may be processed by third-party providers and may also be governed by app-store or payment-provider terms.
Unless required by law or stated otherwise at purchase, fees are non-refundable once the applicable feature has been delivered or used.
10. TagIn intellectual property
The Service, including its software, design, branding, logos, interfaces, databases, features, text, graphics, and other materials supplied by TagIn, is owned by or licensed to TagIn and protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
11. Moderation and enforcement
We may investigate content or conduct and may remove content, limit visibility, restrict features, issue warnings, suspend accounts, terminate accounts, preserve evidence, or report conduct to authorities when we reasonably believe it is necessary to enforce these Terms, protect users, comply with law, or maintain the Service.
We are not obligated to monitor every interaction and cannot guarantee that all violations will be detected or resolved. Enforcement decisions may consider context, severity, history, risk, and available evidence.
12. Third-party services and links
The Service may rely on or link to third-party maps, venues, ticketing sites, payment processors, identity providers, social networks, app stores, or other services. We do not control and are not responsible for third-party content, availability, security, practices, or terms. Your use of third-party services is governed by your agreement with those providers.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, error-free, secure, accurate, complete, suitable for a particular purpose, or available in every area.
We do not endorse or guarantee users, profiles, matches, hosts, attendees, events, venues, User Content, recommendations, or outcomes. Any reliance on information obtained through TagIn and any decision to communicate, meet, attend, host, travel, purchase, or participate is at your own risk.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
14. Limitation of liability
To the fullest extent permitted by law, TagIn and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, opportunities, or reputation arising from or related to the Service.
To the fullest extent permitted by law, TagIn's total aggregate liability for all claims arising from or related to the Service will not exceed the greater of: (a) the amount you paid directly to TagIn during the 12 months before the event giving rise to the claim; or (b) CAD $100.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless TagIn and its owners, affiliates, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable legal fees arising from your User Content, your events or activities, your interactions with others, your breach of these Terms, or your violation of another person's rights or applicable law.
16. Suspension, termination, and account deletion
You may stop using the Service and request account deletion at any time. We may suspend, restrict, or terminate access when reasonably necessary for safety, legal compliance, security, non-payment, extended inactivity, or a suspected or actual violation of these Terms.
Provisions that by their nature should survive termination will survive, including ownership, licences already relied upon, disclaimers, liability limitations, indemnity, dispute provisions, and general terms.
17. Governing law and disputes
These Terms are governed by the laws of Manitoba and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
Before filing a claim, you agree to contact support@tagin.ca and make a good-faith effort to resolve the dispute informally for at least 30 days. Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought exclusively before the courts located in Winnipeg, Manitoba.
Nothing in this section prevents either party from seeking urgent injunctive relief or using a small claims process where eligible, and nothing removes consumer rights that cannot lawfully be waived.
18. Changes to the Service or Terms
We may modify, suspend, or discontinue features and may update these Terms as TagIn evolves. We will post revised Terms with a new “Last updated” date and provide additional notice of material changes where appropriate or required.
By continuing to use the Service after revised Terms become effective, you agree to the revised Terms. If you do not agree, you must stop using the Service and delete your account.
19. General terms
- Entire agreement: These Terms, the Privacy Policy, and any incorporated policies form the entire agreement regarding the Service.
- Severability: If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue.
- No waiver: A failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our written permission. We may assign them in connection with a reorganization, financing, sale, or transfer of the Service.
- No agency: These Terms do not create an employment, agency, partnership, fiduciary, or joint venture relationship.
- Electronic communications: You agree that notices and agreements may be provided electronically, subject to applicable law.
